6-2 Final Project Milestone Two: Short Paper: Collective Bargaining—Employee Wages and Benefits - Management
Instructions Students should reflect on the Discussion Topic from the previous module and their experience with the negotiating process. This short paper should include: A copy of the agreed-upon collective bargaining agreement section (posted in the discussion topic) A personal account of the negotiating process. This account needs to include: A listing of the key challenges or points of friction. An analysis of the negotiating principles used by both parties and the BATNA of their own position. A review on the success of interest-based compared to distributive bargaining principles. An analysis of the strength of the other positions – were their positions weak and not supported well or just the opposite? A reflection on how this negotiation session was different than the first one completed under Milestone One in Module Three. What might need to be changed to be more successful in follow-on negotiating sessions? A conclusion about the outcome – did it favor one side or the other? This short paper will be graded separately using the Milestone Two Guidelines and Rubric document. Feedback should be applied to the final project. OL 318 Milestone Two Guidelines and Rubric Overview: In task 5-1, students will participate in the second group discussion. The purpose of this topic is for students to have the opportunity to role-play an actual negotiation session with the goal of developing a collective bargaining agreement. The specific topic to be negotiated is related to employee wages and benefits. In this topic, the instructor will divide students into two groups. One group will represent management and the other group will represent labor. Note: The groups will be the opposite of what they were in Module Three to give students a chance to represent each side. The instructor has provided a rough framework of a collective bargaining agreement in the resources section for this module that provides some level of detail on how the agreement is currently worded. This will serve as the starting point for your negotiations. Students are expected to research the topic and determine the best way to craft the language in the agreement to favor their position. The students should use the Discussion Topic as a negotiating platform and create a dialogue with the opposing side in order to come to an agreement on the specific language required in the agreement. If both sides cannot agree by the end of the module, the instructor will act in the role of mediator/arbitrator and will decide on the final language, which all parties must accept. In this event, the instructor will post the final agreement/document in the topic by midnight on Tuesday of the following module. In task 6-2, students will be required to provide the following as the deliverable:  A copy of the agreed-upon collective bargaining agreement section (posted in the Discussion Topic)  A two-page personal account of the negotiating process. This account needs to include: o A listing of the key challenges or points of friction. o An analysis of the negotiating principles used by both parties and the BATNA of their own position. o A review on the success of interest-based bargaining compared to distributive bargaining principles. o An analysis of the strength of the other positions—were their positions weak and not well supported, or just the opposite? o A reflection on how this negotiation session was different than the first one completed under Milestone One in Module Three. o What might need to be changed to be more successful in follow-on negotiating sessions? o A conclusion about the outcome—did it favor one side or the other? The short paper milestone will be submitted in Module Six. Feedback should be applied to the final project. Requirements of submission: Written components of projects must follow these formatting guidelines when applicable: double spacing, 12-point Times New Roman font, one-inch margins, and discipline-appropriate citations. http://snhu-media.snhu.edu/files/course_repository/undergraduate/ol/ol318/ol_318_cba_example_wages_and_benefits.docx Rubric Critical Elements Exemplary (100\%) Proficient (85\%) Needs Improvement (55\%) Not Evident (0\%) Value Collective Bargaining Details and elaborates on how this exercise increased understanding of the collective bargaining process; clearly assesses the value of mediation and arbitration in this process with specific references Details how this exercise increased understanding of the collective bargaining process; assesses the value of mediation and arbitration in this process Details some elements of how this exercise increased understanding of the collective bargaining process; moderately assesses the value of mediation and arbitration in this process Does not detail how this exercise increased understanding of the collective bargaining process; does not assesses the value of mediation and arbitration in this process 25 The Collective Bargaining Agreement Submits final copy of CBA and personal account of negotiating process with insightful comments on the negotiation showing a high-level understanding of course concepts Submits final copy of CBA and personal account of negotiating process with required details Submits final copy of CBA and personal account of negotiating process with some required details Submits nothing or a copy of CBA and/or personal account of negotiating process with few or no required details 25 Integration and Application All of the course concepts are correctly applied Most of the course concepts are correctly applied Some of the course concepts are correctly applied Does not apply any of the course concepts correctly 20 Critical Thinking Draws insightful conclusions that are thoroughly defended with evidence and examples Draws informed conclusions that are justified with evidence Draws logical conclusions, but does not defend with evidence Does not draw logical conclusions 20 Writing (Mechanics/Citations) No errors related to organization, grammar and style, and citations Minor errors related to organization, grammar and style, and citations Some errors related to organization, grammar and style, and citations Major errors related to organization, grammar and style, and citations 10 Total 100\% OL 318 Module Five Discussion: CBA Example—Employee Wages and Benefits For use in Task 5-1, Discussion Topic: Collective Bargaining—Employee Wages and Benefits, in preparation for Final Project Milestone Two. The following Collective Bargaining Agreement Example is provided as a starting point for the development of a more detailed section that would eliminate confusion and conflict surrounding the specific issues of employee protective clothing, equipment, and tools. From the standpoint of management: · Overtime has been abused in the past; employees would work slowly during the day to ensure plenty of work after hours. · We should all be a team and work together to get the extra tasks completed, regardless of who is doing the actual work; the budget limits how much overtime we can give out so sometimes the supervisors need to help get the job done. · No matter how we divide up overtime, there are always complaints from the workers. From the standpoint of the union: · Management shows favoritism and selectively chooses certain employees to get overtime. · Management takes away the overtime of workers when they get out there and start doing our jobs; we were hired to do a job and management keeps taking away our rights to overtime. Questions that need to be answered in the discussion forum: · Should a supervisor (management) be allowed to work alongside an employee covered by the CBA and thereby minimize or eliminate the opportunity for employees to earn overtime? · Specifically, how should the overtime be distributed to ensure it is done in a fair and equitable manner? · If an overtime list is created, how should it be managed since there are certain workers qualified for some tasks but not others? Should there be several task specific lists created, or an overall shop list? · How does seniority play a role in how overtime is scheduled? ARTICLE 37 OVERTIME A. The Employer agrees to an equitable distribution of overtime. Overtime will be assigned for accomplishment to those employees in an organizational unit where the overtime has become necessary and who would normally perform such work during a regular duty assignment. Overtime is the sole responsibility of the organization supervisor. The Employer will not be restrained from giving consideration to matters of health and differences in individual productivity where supervision is either restricted or absent, special skills, requirements and continuity of work. B. The Employer agrees that unless it gives written notice, neither it nor any function will unilaterally take or permit action that will arbitrarily extend the normal workday without paying overtime or compensatory time, as applicable. C. The Employer agrees to give first consideration to bargaining unit employees in the assignment of overtime before assigning such duties to non-unit employees. Such consideration will include health and safety factors, budget constraints, and employee qualifications. 1
