Free-Market Egg Donation
The Centers for Disease Control and Prevention (CDC) (2019) define infertility as “not
being able to get pregnant after one year or longer of unprotected sex or carry a pregnancy to full
term regardless of marital status.” It is a common problem with about 6\% of women ages 15-44
years old in the US who are unable to get pregnant after one year of trying and 12\% of the same
age range have difficulty getting pregnant or carrying a pregnancy to term (CDC, 2019). Infertile
women or couple resort to assisted reproductive technology (ART) have a child or family.
Decades of developments in reproductive human technology have made human egg donation a
regular business in the US market with 93\% of all fertility centers in the country offering it. Egg
donation frequently benefits women who cannot use their own eggs for various reasons including
ovarian failure, avoiding fetal congenital anomalies, or advanced age (Leonard, 2019). With egg
donation’s popularity, ethical issues arise with some calling for regulations on this lucrative
business. Based on the learning scenario, I agree with Dr. Reynolds that though the market itself
is free of bias, people’s own biases should be presented through the demand and supply that keep
the market alive. Majority of people are not looking to change the fundamental mechanism of the
free market but believe that restrictions should be imposed or eased.
Currently, reproductive technology is one of the least regulated medical specialties in the
US, and physicians and researchers are relatively free to formulate their own policies about
procedural standards (Johnson, 2018). In the scenario, Dr. Nguyen addressed that the free market
is not an appropriate tool for advancing ethical agenda, for example, regarding egg donation.
Phillips (2009) contends that without ethics, the free market is at risk. She further added that the
free market system depends on a transparent, honest and open enterprise to survive and flourish
(Phillips, 2009). Dr. Nguyen continued to say that the free market will behave as it behaves for

better or worse to which I believe ethical discussions are of assistance because corruption
ultimately exacts a price from a company. People who deal in the free market must wield power
responsibly and must recognize that corporate responsibilities go beyond short-term profit and
loss.
Dr. Reynolds argued that though the market itself is neutral, it can be both harmful and
beneficial to society. The “laissez-faire” approach to reproductive technology has growing
sentiments within the US and much of the international community that increased oversight will
be necessary for the future to ensure high-quality reproductive care and minimize harm (Johnson,
2018). It is my belief that it is inappropriate to have a totally free-market system. Regulations are
needed to protect the egg donors and resulting children. There ought to be regulations indicating
just how much information about donors should be put into circulation. For example, no federal
laws regulate the informed consent process such as specifying information donors must be given
before they provide eggs (Cahn & Collins, 2014). Though the American Society for
Reproductive Medicine (ASRM), the self-regulatory association for ART professionals has
developed recommendations applicable to sperm, egg, and embryo donations for both donors and
recipients, this board has no enforcement authority (Cahn & Collins, 2014). It strongly
recommends rather than mandates.
Dr. Ryenolds addressed that ethical issues may arise with compensations to third-party
egg donors. The free-market system of egg donation may seem exploitative as it targets
financially vulnerable young women as potential donors. The lack of a regulatory board can
predispose egg donation to the lack of safety rules and make room for unfairness and injustice. In
2000, the ASRM recommended capping the price of one egg donation to $5000 to ensure that
low-income young women are not dawn to donate by a huge payout as well as promote fairness

across the board (Greenberg, 2015). With minimal government regulation, the prevailing laws,
for now, are those of supply and demand which can result in competition, hence, skyrocketing
payout rates to donors that may not be equal to each individual and ignorance on the long-term
risks since little research has been conducted.

It is important to understand that everyone has their right to an opinion, being it ethical
vs. unethical. Most unethical cases though, are termed as illegitimate reasons, so they are
frowned upon by, or as a society.
As said in the post, a free market brings buyers and sellers close together based on supply
and demand for various products. An example of ivory is given, being that it is an item that is
sold and bought freely, but with the high demand of ivory sales, the result will be the cause of
high mortality rate among thousands of elephants. The issue towards this is regarding whether it
is ethical or not to put ivory products in the market, and according to me, this practice is highly
unethical, as a living being is getting killed for no reason but to either achieve ivory jewelry or
other materialistic objects. So, this being an unethical act, can be prohibited, and this goes for all
the other marketable items in the world.
Regarding the example above, I agree with Dr. Reynolds. She states that that market
place is free of bias, but people present their own biases through the demand and supply that
keep the market alive. She further states that while people are not looking to change the
fundamental mechanism of the free market, one can certainly impose or ease restrictions, which
amounts to imposing desired ethics. I agree with her as an example was given about how invitro
fertilization has enhanced the hopes of individuals who are unable to conceive, but due to the
market that follows it, the prices are extremely high, and individuals who are poor are unable to
achieve their goal towards raising a family. It is dreadful how the market regarding fertilization
likes to only play with people’s feelings and their money, rather than helping achieve their goal
towards growing a family (Gregory, P. 2008).

bringing their excessive cost down.
